Terms & Conditions

1. Topnotch East Associate Staffing Inc. shall endeavor to determine the qualifications and suitability of its Temp (s); however, the client shall have the full responsibility of determining the suitability, stability and qualifications of any Temp (s) supplied by Topnotch East Associate Staffing Inc. for a specific assignment or services agreed upon to be performed by the Temp (s).
   
   
2. It is clearly understood that employees of Topnotch East Associate Staffing Inc. shall not be entrusted with the handling of any valuables such as cash, securities or negotiable documents, except in such situation where the client duly authorizes them to do so. Any such situation shall be at the sole risk of the client.
   
   
3. All employees assigned by Topnotch East Associate Staffing Inc. are covered by the Workplace Safety & Insurance Board. It is understood and agreed that it is the responsibility of the client to ensure that all machinery and/or vehicles and other properties whether leased or owned shall be covered by insurance with a minimum of $1,000,000.00 public liability, property damage, fire, theft and collision. In addition, all employees shall have the full benefit and protection of such insurance.
   
   
4. It is understood and agreed that the client shall provide direct supervision or directions to all employees of Topnotch East Associate Staffing Inc. during the assignment at that particular location.
   
   
5. It is understood and agreed that our working week consists of forty-four hours or as agreed with our client. Any hours worked in excess of 44 hours shall be billed at time plus one half of the agreed contract price. Our invoices are prepared and mailed weekly and they are due upon receipt.
   
   
6. Our understanding of the temporary help industry and our expertise in meeting specific client’s needs help us supply good quality people, 24 hours a day. As part of our commitment to service, we offer an unconditional guarantee. If, for any reason, you are dissatisfied with the performance of any of our temps and we are notified within 4 hours of the start time, we will absorb all costs for the temp, that day.
   
   
7. It is understood and agreed that employees once assigned to specific duties, such duties should not be changed or an employee shall not be moved to a different location without prior notification been given to Topnotch East Associate Staffing Inc.
   
   
8. It is entirely the responsibility of the employee to ensure prompt arrival to all assignments at the time specified by Topnotch East Associate Staffing Inc. and/or the client company. However, if the Client does not cancel a job order for flexible staff at least 2 hours before the beginning of the shift and the employee arrives promptly at the client’s company, the employee shall be paid for 4 hours of work that day. These hours will subsequently be billed to the client.
   
   
9. Client undertakes and agrees to indemnify and save Topnotch East Associate Staffing Inc. harmless from any and all claims against it arising from any alleged responsibility for any acts or omissions by any person employed by the Client, notwithstanding any provision or law imposing or seeming to impose any such responsibility upon Topnotch East Associate Staffing Inc.
   
   
10. In the event a Client of Topnotch East Associate Staffing Inc. elects to make a permanent position available to a worker, such offer shall not be made until twelve complete billing weeks have occurred. This provides both the Client and the worker the opportunity to make an informed and experienced decision. There shall be no separation fees due after our twelve weeks trial period.
